A note of issue is a document, prepared by the appellant, which must be filed when perfecting an appeal in the First Department (a sample note of issue is on the Court’s website). The note of issue must state 1) the term of the court for which the appeal is noticed; 2) the date of the notice of appeal; 3) the date the judgment or order appealed from was entered; 4) the name of the justice who made the decision; 5) the nature of the appeal or cause; and 6) the index or indictment number and the Appellate Division case number, if any.
